To many people the study of history is quite disgusting as a subject because the reality is often masked by the creation of myths to hide what has really happened and make it more 'homely and loveable'. So, if in doubt about the truth and the legend... then print the legend! Legal history in particular is not something lawyers can be proud of concerning sentencing and the original processes of the development of the early common law in the eighteenth and nineteenth centuries. However, we learn much from the life of William Garrow and Hostettler's companion to the series is most welcome. Garrow's position is now assured as the pathfinder of modern the adversarial system which has been recognized internationally as the basis of a sound legal system. So what did Garrow achieve? Hostettler sets out to find the truth behind the myths, and he undertakes the task with brilliance and accuracy. What we have with this new book from Waterside Press is a compliment the BBC series with well-researched details about the three seasons of stories which have been filmed, and the individual cases arising in the episodes which are more extensively explored from the base of historical fact, however horrific it may seem to us today with the excessive use of hanging. 'Garrow's Law' was watched by some 5 million people who were captivated by the storylines. What Hostettler does is set the scene of the times in which Garrow lived and the picture we conjure up is compelling. We found this a riveting read from cover to cover and it is a wonderful companion to the BBC series which was so desired by all 'Garrowites'. Darrow is considered to have been the greatest lawyer in American history. But nonetheless, the book's compass points inevitably to England and to such legal luminaries as Sir Edward Marshall Hall -- and in the 20th and 21st centuries, Helena Kennedy QC and Shami Chakrabati. Speaking of female lawyers, famous or not, author John Hostettler points out intriguingly, that women were excluded from the legal profession until 1919 (horrors!) when, following their spectacular and often self sacrificial contributions to the war effort during the Great War, the Sex Disqualification (Removal) Act was enacted. This pivotal piece of legislation abolished all the then restrictions on the admission of women into the professions. Such illuminating insights fill the pages of this quite absorbing book from the well-known biographer of Sir William Garrow. The selection of these 20 famous names is by no means complete (it could not be otherwise). But individually and collectively, these mini-biographies reveal the continuingly evolving story of the law -- the high profile cases -- the legal principles -- and the interpretation and application of justice across cultures and across historical periods. BOOK REVIEW THE DAY THE KING DIED A Terrible Miscarriage of Justice By Jim Morris Foreword by Glyn Maddocks Waterside Press Putting justice into words ISBN: 978 1 90997 613 9 www.watersidepress.co.uk JIM MORRIS GIVES ANOTHER STRONG REASON WHY CAPITAL PUNISHMENT IS TOTALLY WRONG: COMPULSORY READING FOR ALL WHO OPPOSE JUDICIAL HOMICIDE An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers This is another excellent and well researched book from Waterside Press who have courageously taken on the task of publishing a further example of why judicial homicide should never return even though over half the planet still practice it: will they never learn! Waterside Press has put justice into words yet again. An experienced writer, Jim Morris provides sufficient meticulous evidence in our view to substantiate a strongly held feeling that the entire justice process in Alfred Moore’s case was both unsafe and unsatisfactory whatever the faceless public servants say about this today and other clearly bad miscarriages of justice that they have wished to cover up in the past to keep their consciences clean. The issue of dying declarations also raises its controversial head because an issue of motive in giving the statement can never be wholly resolved. The subject of this book is Alfred Moore and his clearly unappealing activities from virtually day one. His life was a mess from the start but the issue remains as to whether he was a killer and it seemed quite clear that the ‘beyond reasonable doubt’ concept was discounted in his case by the legal profession (one of many unfortunately). Morris has produced a readable and highly detailed account of the events in Moore’s life and death. Moore’s case continues to receive substantial publicity after his hanging the day George VI died (an hour early so he was executed) - it is a blatant wrong which can never be righted but the Home Office and the appeals system will of course continue to ignore the protests - the book then is doubly welcome for highlighting what took place in 1951 and 1952 and as a reminder of why we should not do things this way in future. It is unfortunate that we shall never know the real events of 15th July 1951 but this book does show up some less savory aspects and attitudes of members of the Bar and the Judiciary for what sort of people they were at that time: pretty bias against certain classes of people, frankly, using evidential proof (including questionable dying declarations based on the old common law principles) in the wrong way to get rid of undesirable people. Waterside Press is fast gaining a high reputation for the quality of the titles they publish and “The Day the King Died” is one such title. We were intrigued by the title and this “quaint British convention” whereby executions were stopped and a sentence commuted if scheduled to take place on the day the sovereign died. How odd! But possibly such a convention may have its roots in the link between capital punishment and religion as the sovereign is the top person in the country before God so there is a teeny-weeny bit of a saving grace when ‘thou shalt not kill’ becomes ‘thou shalt kill’ because ‘thou’ has murdered someone. A pretty pathetic way of assuaging one conscience, then! But, of course, in a primitive society which practices judicial homicide that “quaint British convention” makes it alright presumably as a sort of medieval ‘blood money’ for the conscience just in case there is a hereafter. Equally unfortunate, we cannot interview George VI for his views one way or the other (even if we were allowed to do so to examine a prerogative of mercy, which we would not) but the title of this book is a stark reminder of why “The State” should not judicially kill people. “The Day the King Died” should be compulsory reading for all law students and criminologists who become associated with our modern criminal justice processes - we learnt something from Jim Morris: you cannot bring back the dead to ask them questions whether it’s a sovereign or the subject of a hanging.

BOOK REVIEW FINE LINES AND DISTINCTIONS Murder, Manslaughter and the Unlawful Taking of Human Life By Terrence Morris and Louis Blom-Cooper Waterside Press ISBN: 978 1 904380 66 5 www.watersidepress.co.uk CALLING FOR 'A ROOT AND BRANCH REFORM OF THE LAW OF HOMICIDE' An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers In the Foreword to this thought provoking book, Lord Judge writes: 'I doubt whether any reader of this book will agree with everything in it. And I readily admit that, although happy to write the Foreword to such a stimulating and important work, I do not.' That the Lord Chief Justice should state unequivocally that he cannot agree with everything written in a book for which he has written the Foreword is less dismaying than inspiring when you come to think of it. It exemplifies the tradition of fair comment, fair play and fair minded debate, not to mention the (almost) universal acceptance in the UK of the principle of agreeing to disagree. Yes, the book is controversial. And on reading it, you may not entirely agree with it either, although you may well agree with it in part. The subject matter is murder: -- the various kinds of murder; whether murder, or manslaughter, whether deliberate or accidental -- and the punishments, whether appropriate or inappropriate -- that have resulted and/or should result. What does result—and the book is pretty convincing here -- is that poorly thought out 'messy laws' confuse juries, while 'adept legal minds', not to mention ordinary folk, are equally confounded by 'fine lines and distinctions' typically (but not always) of the kind referred to above. The 'fine lines and distinctions' of the title echo the words of both Lady Wootton and Lord Parker in the course of the Parliamentary debate which led to the abolition of the death penalty in the UK in 1965. In its place remains the mandatory life sentence for murder and all the attendant difficulties emanating from that. Following years of copious research, analysis and professional experience both eminent and distinguished authors agree that 'the English law of homicide is in a mess.' Reference is made throughout to specific cases; for example the case of Tony Martin, the Norfolk farmer who eventually was sentenced initially to life imprisonment for murder and following an appeal, to five years for manslaughter, on grounds of diminished responsibility for shooting and killing a burglar who, with his cohorts, had persistently targeted his property. One is reminded on reading this, of the thorny issues raised by this case and the controversies that raged around it and still do. One is also reminded of the current proposals to protect householders from prosecution resulting from having to defend their homes and families against criminal intrusion. The complexities which could result, most of which are raised in this book, are truly and oppressively mind-blowing. Published in 2011 by the Waterside Press, this timely, provocative and certainly topical book puts forward a closely argued and well supported case for encouraging 'a root and branch reform of the law of homicide', a reform which must depend on legislation and therefore parliamentary -- and we would add, public support. The book will therefore provide ample evidence and ammunition to those who would agree that such a reform should be put in place as a matter of urgency.

An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers In 300 pages, which must be a record for a serious statement of the problem which is criminal justice today, the 4 editors, Katherine Doolin, John Child, John Raine and Anthony Beech, have produced a highly readable statement on where we might be going with the criminal justice process in the next decade after years of legislative change. There are 18 contributors to "Whose Criminal justice?" and they have come together under the newly founded Birmingham Criminal and Community Justice Group (BCCJ Group) covering a range of areas including law, criminology, forensic psychology, social work and public management. The overarching theme throughout the work is the balance between the role of central government in creating and shaping the regulatory framework of criminal justice, and the potential for communities at local level to become more involved and to exercise more responsibility for themselves in responding to crime and anti-social behaviour in their midst. And all this now under a new Coalition Government after years of single party political control of government, and the relative failures of many implemented measures. The twin dynamics are examined in detail in the two main sections of the book. In Part I (The Regulatory State) through a series of case-studies, the authors examine how the central state has sought to address the risks and problems associated with crime and anti-social behaviour in modern times. The authors consider the new context for law and order which has arisen and question how and why new sanctions were put in place to regulate particular kinds of behaviour. They also highlight some of the unintended consequences, notably the "criminalization" of more people, and the reality of the sanctions themselves as criminal justice is reviewed by the coalition. In Part II (Empowered Communities as Stakeholders in Criminal Justice) -- from chapter eight onwards- the book explores the potential for local communities to play a greater role in addressing the problems of crime and anti-social behaviour in their own neighbourhoods, which will probably be linked in to the developing concept of the 'Big Society'. In the second section of the book, the authors also consider the prospects for crime reduction through a more 'localist' approach in which citizens and communities play a more active part in a 'Big Society' which David Cameron has now launched. We welcome this book, primarily of great use to applied criminologists and all those interested in the criminal justice process generally because it provides a timely and topical stock-taking of the key issues and challenges. Through an exploration of the relative strengths and limitations of 'centrist' and 'localist' approaches to tackling crime and anti-social behaviour, this title from Waterside Press offers a prescription of principles and priorities for a way forward for the next decade and it will be of great interest to see what actually happens as the second decade of the century unfolds. Yes, it is another useful work for a wide readership from Waterside as the new agenda is being set at the present time.

Sean Portass, 46, chopped off part of the 25ft branch which hung over on to his roof, getting in the way of building work.
